Terms of Service

Please read these Terms of Service ("Terms") carefully before using the AI Security Scanner platform ("Service") operated by SecureAI ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Service Description

AI Security Scanner is a security scanning platform designed to identify vulnerabilities and threats in agentic AI systems. The Service provides:

• Automated security scanning and vulnerability detection for AI agents and LLM-based applications
• Threat analysis and risk assessment reports for agentic AI deployments
• Compliance monitoring and security posture dashboards
• API access for integrating security scanning into CI/CD pipelines
• MCP (Model Context Protocol) server access for AI-native security tools

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

2. Account Responsibilities

2.1 Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Keep your password and API keys secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

2.2 Usage Limits

Your account is subject to usage limits based on your subscription tier. These limits include the number of security scans, API calls, team members, and data retention periods. Usage limits are detailed on our pricing page. Exceeding your plan limits may result in service throttling or additional charges.

2.3 Team and Enterprise Accounts

If you create or administer a team or enterprise account, you are responsible for ensuring all members comply with these Terms. You are the designated administrator and must manage access permissions and member conduct.

3. Billing and Payment

3.1 Merchant of Record

All payments are processed by Paddle.com Market Limited ("Paddle"), our merchant of record. By purchasing a subscription, you agree to Paddle's terms of service and privacy policy in addition to these Terms. Paddle handles all billing, invoicing, sales tax, and VAT calculations on our behalf.

3.2 Subscription Billing

The Service is offered on a subscription basis with the following terms:

• Subscriptions are billed on a monthly or annual cycle, depending on the plan selected
• Annual subscriptions are billed upfront for the full year at a discounted rate
• Your subscription will automatically renew at the end of each billing period unless canceled
• Price changes will be communicated at least 30 days in advance of the next billing cycle
• A free tier is available with limited functionality and usage quotas

3.3 Refund Policy

Refund requests are handled through Paddle in accordance with applicable consumer protection laws. Generally:

• Monthly subscriptions: You may cancel at any time; access continues until the end of the current billing period. No partial-month refunds are provided.
• Annual subscriptions: A pro-rata refund may be available within the first 14 days of purchase or renewal. After 14 days, no refunds are issued.

4. Data Handling

4.1 Data Processing

When you use the Service, we process data you submit for security analysis. This includes code snippets, repository configurations, AI agent definitions, and related metadata. We process this data solely for the purpose of providing security scanning results to you.

4.2 Security Measures

We implement robust security measures to protect your data:

• All data is encrypted in transit (TLS 1.2+) and at rest (AES-256)
• Code analysis occurs in isolated, ephemeral environments
• We maintain SOC 2 Type II compliant infrastructure
• Regular penetration testing and security audits are conducted
• Access to customer data is restricted to authorized personnel with a legitimate business need

4.3 Data Retention

We retain data according to the following schedule:

• Submitted code: Deleted immediately after analysis is complete
• Scan results and vulnerability reports: Retained for the duration of your subscription plus 90 days
• Account and billing data: Retained for 7 years after account closure for legal and tax purposes
• Usage logs: Retained for 2 years for service improvement and security monitoring

5. Intellectual Property

5.1 Platform Ownership

The Service, including all software, algorithms, machine learning models, user interface designs, documentation, and related intellectual property, is and remains the exclusive property of SecureAI. Nothing in these Terms grants you any ownership rights in the Service.

5.2 Your Data Ownership

You retain all ownership rights to the code, data, and content you submit to the Service. We do not claim any ownership interest in your data. We will not use your code or data to train AI models without your explicit, opt-in consent.

5.3 License Grant

By submitting data to the Service, you grant us a limited, non-exclusive, revocable license to process your data solely for the purpose of providing the Service to you. This license terminates when your account is closed and data retention periods have expired.

5.4 Scan Results

Security scan results, vulnerability reports, and risk assessments generated by the Service are provided to you under a perpetual, non-exclusive license. You may use, share, and distribute these results within your organization as needed.

6. Limitation of Liability

6.1 Service Provided "As-Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

6.2 No Security Guarantee

While we strive to provide comprehensive security scanning, we do not guarantee that our Service will identify all vulnerabilities or security threats in your AI systems. The Service is a tool to assist your security efforts and does not replace professional security audits or human security expertise. You are responsible for your own security decisions and measures.

6.3 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SECUREAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED US DOLLARS ($100).

7. Termination

7.1 Termination by You

You may terminate your account at any time by canceling your subscription through the dashboard settings or by contacting support@ai-threat-scanner.com. Upon cancellation, your access to paid features will continue until the end of the current billing period.

7.2 Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms or the Acceptable Use Policy (Section 9)
• Fail to pay applicable fees after reasonable notice
• Engage in activities that harm other users or the integrity of the Service
• Use the Service in a way that violates applicable laws or regulations

7.3 Effect on Data

Upon termination:

• You may export your data for up to 30 days after termination
• After the 30-day export period, your data will be deleted in accordance with our retention schedule
• Billing data will be retained as required by law (see Section 4.3)
• Anonymized and aggregated data may be retained indefinitely for service improvement

8. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

9. Acceptable Use Policy

You agree not to use the Service to:

• Conduct illegal activities or facilitate the violation of any applicable law or regulation
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Service
• Abuse, overload, or disrupt the Service or its infrastructure, including through automated scraping, denial-of-service attacks, or excessive API usage beyond plan limits
• Attempt to gain unauthorized access to other users' accounts, data, or any non-public portions of the Service
• Develop competing products or services using insights gained from the Service
• Use the Service to identify vulnerabilities for malicious exploitation rather than defensive security purposes
• Resell, sublicense, or redistribute access to the Service without prior written consent
• Submit malware, viruses, or other harmful code to the Service with the intent to compromise our systems

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice or refund.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on this page with a revised "Last updated" date
• Sending an email notification to the address associated with your account
• Displaying a prominent notice within the Service

Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.

11. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and SecureAI regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service disruptions.
